H.E. President Abdel Fattah El Sisi has ratified Law no. 163 of the year 2023 for the establishment of the Egyptian Organization for Intellectual Property Rights (EOIPR) in accordance with Egypt’s Vision 2030. The presidential decree was published in the Official Gazette on 13 August 2023 and will be entered into force the following day.
The ratification of the law follows the parliamentary approval of the draft on June 20, 20223 for the EOIPR’s establishment.
The national strategy for intellectual property was introduced by Prime Minister Moustfa Madbouly in September 2022 with the aims to realize governance of institutional structure of IP by establishing a national apparatus for IP and review of the existing legislations. The national strategy’s implementation will comprise of two transitional phases, the second of which is the establishment of the EOIPR.
The establishment of the EOIPR will result in the consolidation of all relevant authorities and ministries responsible for protection of IPRs under one roof, with the newly formed entity being the sole authority responsible for the regulation of intellectual property rights in Egypt. Article 2 of the decree indicates that the newly formed EOIPR and its Head will replace thethe ministers and authorities and institutions currently responsible for the laws protecting IPRs and its executive regulations.
The decree is to be implemented within one calendar year; a time extension of six months is permissible by execution of a Ministerial decision.
The ratification of the decree and the unification of entities is a positive step forward for IP protection in Egypt and is expected to further enhance the protection and regulation of intellectual property rights via the promotion of the use of IP in scientific research, raising awareness, and increasing contributions towards the national economy.
