Important Update on Trademark Prosecution Requirements in Libya: Guidance Number 694,3.2.5 Issued by the Ministry of Economy

The Libyan Office of the Ministry of Economy has on 14 February 2024, issued guidance number: 694,3.2.5 updating the trademark prosecution requirements in Libya.

 

When applying for a trademark registration at the Trademark Office, the following shall be complied with:

 

1-The power of attorney shall be valid for one year, and renewed for like terms.

 

2-Official documentation shall be locally attested by the Ministry of Foreign Affairs and International Cooperation in Libya in order to confirm the validity of the legalization of Libyan embassies abroad.

 

3-As of 1 May 2024, applicants must provide an official extract of the commercial register or its equivalent in the event that a Commercial Register has not been issued in the applicant’s country. It’s issuance date must be within one calendar year and the extract must be accompanied by an Arabic translation.

 

4-Documents related to the assignments and recordals post-registration shall be original and duly legalized, as well as accompanied by an Arabic translation.

 

5-The applicant’s commercial register number must be included on the trademark application.

 

6-The applicant’s name must be translated into Arabic in the trademark application.

 

The guidance also required that agents renew their agent registration before the Trademark Registrar.  We confirm that Eldib & Co has already adhered to this requirement and received the requisite approval on 06 February 2024.
